Understanding Pardon Applications and Record Suspensions

A suspension basically allows someone who has previously been convicted of an offence, but has completed the sentence and demonstrated that he/she is a law abiding citizen for a specified number of years, to have his/her criminal record separated from other criminal records.

Who has Record Suspension Authority?

The body charged with assessing and issuing criminal suspensions in Canada is the Parole Board of Canada (PBC). The PBC is a government agency that is a department within the Canadian Ministry of Public Safety. It draws its authority for criminal pardon from the Corrections and Conditional Release Act.

WHAT ARE THE BENEFITS OF THE PARDON?

As of March 13 2012, the term “Pardon” has been replaced with “Record Suspension”. Criminal records constitute a hindrance to your life by restricting access to employment, career development, training and travel.
A criminal record can be an obstacle to an application to many job sectors such as banking, insurance, security, government, finance, business.

Prior to travel, some countries require you to apply for a travel visa. A criminal record can create problems if you wish to travel. To successfully obtain these visas, you must prove that you are law abiding and you do not present any risk or a hazard to the countries being visited (see more details on the entrance to the United States section);

Generally, during the imposition of a sentence, a person who has a criminal record will be dealt with more severely than a person who has never been convicted. The criminal record is the tool that determines who has previously committed a crime.

The criminal record limits your right to training, employment, promotions, obtaining licenses/permits and may cause insurance companies to refuse you as a customer (home insurance, car insurance, health insurance) or charge you higher rates.
